1. Introduction

This Policy forms an essential part of the Terms & Conditions and applies to all users, transactions, disputes, communications, and platform activities.

ChannelCow operates solely as an independent technology platform facilitating interactions between buyers and sellers of digital creator assets.

ChannelCow is NOT:

  • The owner of listed assets
  • A broker-dealer
  • An investment advisor
  • A banking institution
  • A licensed escrow company
  • A legal representative of users
  • A guarantor of transactions
  • Responsible for third-party platform actions

Transactions occur directly between independent users.

3. No Guarantee of Transactions

ChannelCow does NOT guarantee:

  • Successful transaction completion
  • Transfer approval by third-party platforms
  • Revenue continuity
  • Audience retention
  • Asset profitability
  • Monetization stability
  • Subscriber authenticity
  • Future traffic
  • Platform compliance
  • Search rankings
  • Account security after transfer

Users acknowledge that all transactions involve uncertainty and business risk.

4. Third-Party Platform Risks

Digital assets listed on ChannelCow may depend on third-party services including:

ChannelCow has no control over:

  • Platform algorithms
  • Policy enforcement
  • Monetization decisions
  • Copyright systems
  • Account suspensions
  • Audience distribution
  • Search visibility
  • Ad restrictions
  • Platform bans

Users assume all risks associated with third-party platforms.

5. No Warranty

The Platform and all services are provided on an:

  • “As available”
  • “Without warranties”

ChannelCow expressly disclaims all warranties including:

  • Merchantability

No oral or written information provided by ChannelCow creates any warranty unless explicitly stated in writing.

6. No Responsibility for User Conduct

ChannelCow is not responsible for the actions, behavior, statements, or conduct of users.

This includes:

  • Fraudulent sellers
  • Fraudulent buyers
  • False listings
  • Fake screenshots
  • Manipulated analytics
  • Misrepresentations
  • Unauthorized recovery attempts
  • Harassment
  • Intellectual property violations

Users interact with each other at their own risk.

7. No Liability for Financial Losses

To the maximum extent permitted by law, ChannelCow shall not be liable for:

  • Lost profits
  • Revenue decline

  • Copyright strikes
  • Community guideline strikes
  • Platform suspensions
  • Account removals
  • AdSense rejection
  • Platform policy changes
  • Algorithm updates
  • Audience reach reductions

even where such events occur shortly after a transaction.

9. No Liability for Security Incidents

ChannelCow shall not be liable for losses arising from:

  • Hacking
  • Credential theft
  • Phishing attacks
  • Unauthorized access
  • Social engineering
  • Malware
  • Account compromises
  • Data breaches caused by third parties

Users are responsible for maintaining account security and protecting credentials.

10. No Liability for Technical Failures

ChannelCow shall not be liable for losses caused by:

  • Server downtime
  • Software bugs
  • Internet outages
  • API disruptions
  • Hosting failures
  • Database issues
  • Payment processor interruptions
  • Technical malfunctions

The Platform may become unavailable temporarily without notice.

11. No Liability for Payment Processor Decisions

Users acknowledge that payment processing may involve third-party providers.

Users are responsible for independently evaluating all information.

14. Limitation of Monetary Liability

To the fullest extent permitted by law, ChannelCow’s maximum aggregate liability arising from any claim, dispute, transaction, or use of the Platform shall not exceed:

  • Monetization systems may change unexpectedly
  • Fraud risks may exist despite verification efforts

Users voluntarily assume all risks associated with transactions conducted through the Platform.

17. Force Majeure

ChannelCow shall not be liable for delays or failures caused by events beyond reasonable control including:

  • Natural disasters
  • Government actions
  • War
  • Cyberattacks
  • Power outages
  • Internet disruptions
  • Payment system failures
  • Regulatory changes
  • Labor disputes
  • Platform-wide outages

18. User Indemnification

Users agree to indemnify and hold harmless ChannelCow and its affiliates from claims arising from:

  • User misconduct
  • Fraud

  • Third-party claims

  • Breach of agreements

19. No Fiduciary Relationship

Nothing in the Platform relationship creates:

  • Employment relationships

20. Jurisdictional Limitations

This Policy shall be governed by the laws of India.

Users agree to submit to the exclusive jurisdiction of courts located in Punjab, India.

ChannelCow reserves the right to modify this Policy at any time.

Updated versions become effective immediately upon publication.

Continued use of the Platform constitutes acceptance of revised terms.
